A: Any time a car is “purchased” the applicable amount of sales tax must be charged and collected. From what you described, you bought the car from your husband. If you go to craigslist.com, you can search all of the local listings in there and narrow it down by price. If you decide to try an auction, make sure you have someone with you that knows what they’re doing. You can either find a gem there, or get seriously taken.

In-transit License
An in-transit license is required for a drive-a-way operator who transports and delivers a vehicle in this state from the manufacturer or another point of origin to a location in this state using the vehicle’s own power or using the full-mount method, the saddle-mount method, the tow-bar method, or a combination of those methods.
Drive-a-way operators may apply for, receive, and attach metal in-transit license plates to the vehicles they transport. The drive-a-way in-transit license and the metal in-transit plates expire on March 31 regardless of when the application was submitted; the full fee must be paid regardless of when the application was submitted.

Lease Facilitator
The lease facilitator license allows a person to hold himself or herself out to be a leasing agent or leasing company. This person solicits someone to enter a contract of agreement to lease a vehicle. A lease facilitator by definition, is not the lessor or owner of a vehicle, but rather someone who puts the lessor, selling dealer and lessee (buyer) together.
Lessor License
The lessor license is required of a person who, under the terms of a lease agreement in excess of 180 days, gives another person the right to possess and use a motor vehicle that is titled in the name of the lessor.
A lessor licensee does not need to have a lease facilitator license to facilitate leases for themselves. The lessor license includes the ability to facilitate its own leases. However, if the lessor facilitates leases between lessees and other lessors, they would need a lea

You’ll need the assigned title from the seller, the bill of sale, proof of insurance, proof of ID, and proof of TX residency to register the vehicle.

In TX the tax is levied at the higher of the BOS price or the state’s estimated value of the vehicle unless the vehicle was purchased from a licensed TX dealer. If it’s bought from a TX licensed dealer, the BOS price is used.

A: No, you only pay the tax once when you go to transfer ownership.

A: Are you asking about sales tax or interest rates? Private sellers do not collect sales tax. If you’re asking about interest rates, depending on the year of the car, 12% may be high, but it can also be ok. If the car is a 2000 model, then your rate will be higher than say a 2007 model.

Q: False claim: Breach of contract on automobile sale. They reposessed car in middle of night from garage.?
My parents bought a new SUV in the Dallas, Tx area about a month ago. Last week it was stolen out of the garage in the middle of the night. The police were called and it was reported as a stolen vehicle. A couple of days ago my mother called to make her first payment (not due for another 2 weeks) and found that the finance company that the dealership used had no record of her. They said that the dealership may have just been slow in sending the paperwork off to call them and see if the paperwork was in the mail. When she called the employee that took her call said that he was under orders from his boss to not talk to her and that her vehicle was not stolen that it had been repossesed for breach of contract. He would give no further info. She asked to speak to the woman who filed her financing at the dealership, and was told she no longer worked there. Mom called the police and they talked to the dealership and found out that they claimed that she was in breach of contract because she used her name and credit to purchase a vehicle for someone else. The vehicle has only been used by my parents, and fully licensed and insured in their names. The accusation is unbelievable!!! The police also told her that even if they had grounds to repo, they were still tresspassing by going in the garage. She does not have the money to hire a lawyer and does not know what actions to take. Oh, and to make matters worse, her old car that had been parked next to the new has a dent in it with the same color paint as the new one (guessing in their quick thieving in the middle of the night they damaged it). The name of the dealership is Southwest Hyudai in Dallas, Tx. Does anyone have any advice?? Know any pro bono’s in Texas (they live near Dallas in Mansfield)?? A: You need to go to your local DMV office with all supporting documents. Contracts, sales orders, etc. You need photos of the damaged car as well

File a formal complaint with the DMV. There will be a few forms to fill out, but it is worht the time. The DMV will inspect this for you, and enforce any rules that have been violated.

As a dealer, I can tell you with 100% certainty that dealers are FAR more afraid of, and responsive to, a DMV complaint than a lawsuit. DMV has the ability to levy fines, restrict your license, audit every single deal, and even shut a dealer down if there are violations.

There is no charge to file a complaint. But I stress you MUST go in person to the DMV. Also, make sure you go to the main office. Most satellite offices do not have a professional licensing division officer on staff. So go to the main DMV office

A: Here is something else you need to pay attention to. These scammers are a team. They have constructed an elaborate website that looks and feels like an Ebay site, but it isn’t. Pay attention to the fine detail of the URL, it is real similar, but not the same as the real thing. They require a deposit of half the sale price. Once you send it (Western Union, not paypal – red flag!!!) they are gone and you will not be able to recover.

Q: Is there a limit to the number of car titles you can transfer from your name in one year in TX?
I have a friend who is the sales manager at a local car dealership. He has been allowing me to buy some of his trade ins at cost, and then I resell them on the open market. As I don’t have a dealers license I have to pay taxes and register the car in my name. A new title is also issued for the car under my name. A buddy told me that there is a limit to the number of title transfers you can do in one year. I have searched but can’t find any info on this subject, does anyone know? I have already done three cars this year under my name. I’m located in Texas. I really don’t want to have to pay fines for too many title transfers or have the new owner of a car encounter a fine.

A: In FL the limit is 4. I imagine TX must have a similar rule

I have heard numerous times that in TX, you can no longer tell them the price you payed for the car or use a bill of sale to indicate the tax price. That they rather go by the blue book value to figure the taxes.

A guy had recently said that he was also told this, went in to the DMV with a bill of sale and was taxed for the BOS price.

A: If you bought your car from a TX registered car dealer, they’ll use the BOS price.

If you bought from an out-of-state dealer or a private party, they’ll charge sales tax based upon the higher of the book value or the BOS price.

Actually, it’s not the Blue Book value but what TX calls the “Standard Presumptive Value”. It is based upon book value, adjusted for mileage. However, if your BOS lists a higher price than the SPV, you will pay tax based upon the BOS price.

So I just left it alone , just last week the cars transmission stalled and the car overheated I pulled over over immediately called the car lot and they towed it in for repairs , so they ended up fixing the a/c , transmission & a corroded freeze plug, i payed 125$ down on the repair fees and agreed to pay the rest out. Within twenty minutes of me driving it the temp gauge went all the way up and the engine started knocking i pulled over and called the car lot and they sent a tow truck to come and get it and when i asked what to do about a ride home they said ” sorry i can only send a tow truck” so i had to walk 3 miles to get home in the Texas heat, anyhow i also noticed that on the underside of the engine there is a ton of rust? what could this be? Last time they had the car in to fix they had it for a week and now who knows how long they will have it again so none the less i am stranded and afoot and it really sucks i don’t know what to do this car has repeatedly made me late for work and left me stuck on the side of the road in this terrible heat wave i am not sure what to do at this point

A: Is the title for this car clean? This car sounds like a Katrina Flood victim. I’m just speculating but if there is that much rust around the engine this car had to be submerged. I’d be asking some questions about the title to see it has a salvage title or a repaired title (use to be salvage but is now showing clean).

A: See if your state has a lemon law – I would also contact a lawyer about what you can do.

Q: My car was gifted to me & the title signed over in my name, do I have to register before I sell it?
My car was bought by my brother in 2004 from carmax with a loan. This happened in Houston, TX. The loan is now paid off and on the title it says carmax was the previous owner and my brother is the current owner. My brother gifted me the car and on the title (which is from Texas), he filled in my name on the back and handwrote a receipt saying I purchased it for $500. The date of sale to me on the title is June 1 2009.
However, I have since moved to NY but have not yet registered the car. I think their are some penalties involved. My question is, do I have to register the car in my name before I can sell it or trade it in, or can I trade it in without registering it? The reason I ask is that my name is already filled in at the back of the title, and the title is from a different state. Please advise. Thanks

A: We get this question a lot. You MUST register the car in your name before you can sell or trade it in. Until you register it in your name it really does not belong to you so you can not legally sell it. It’s not your property, therefore you can not give a buyer a CLEAR title.

Although your brother signed the car over to you he is still the registered owner of record on the Texas DMV records because you haven’t completed the transfer by registering it in your name. The simple reason is that each time a car is sold the state wants some money, and you’ll have to pay sales tax on the $500.

Q: URGENT! Anything I should know before I sell my car?

I am taking $1000 down and they purchaser is going to pay me 15 weekly payments of $100 to cover the remaining $1500 of my asking price. (2500 total).

I downloaded a bill of sale and added a section about the installments so it’s worded as followed:

I, [my name] (hereby referred to as “seller”) of Harris County, Texas for and in consideration of $2500.00 and other considerations to me and in hand paid by [Buyer's name] (hereby referred to as “purchaser”) the receipt for which is hereby acknowledged, have bargained, sold and delivered, and by these presents do sell and delivery unto the said [his name] in the County of Harris County, Texas the following vehicle:

The purchaser has paid down $1000.00 and will make fifteen (15) weekly payments of $100 with the first being paid on July 10, 2009 and the final being paid on or before October 16, 2009.

Should the purchaser default on this agreement by missing any of said payments, the seller retains all right and permission to repossess the vehicle and the purchaser will willingly release the vehicle to the seller in this event.

I will also be getting copies of licenses, ss cards, insurance and a utility bill.

I shipped a 2001 suv from Philadelphia to PR last year. I paid about $2000 total. I used La rosa del monte, but any mover would work. Q: How do I request that a speed bump be put on our street?
People drive way too fast in my neighborhood (I live in Carrollton, GA). I’m afraid that one of the kids on my street is going to be killed by the fast cars. The speed limit is 25–most cars driving on my street go at least 50. Who do I need to contact to get a speed bump placed on our street?

A quicker, yet short term solution would be to ask the police department to patrol your street more frequently.

Finally, I would advise against speed bumps, and instead ask for things like traffic circles, diversion barriers, etc. Speed bumps cause all sorts of problems for many different types of vehicles, and can cause a vehicle travelling at a high rate of speed to lose control, potentially being a bigger threat than just a speeding vehicle.

Q: Why is the oil light in my 1989 Honda Accord on?
Yesterday morning the oil light came on in my car, but I had the oil changed a couple of weeks ago (literally almost two). I took it in to Kwik Kar and they said there was no oil leak and the oil level was fine and simply just told me to stop driving it (which I honestly cannot do with my schedule right now).

What could possibly be wrong with it? Where should I take it in the Carrollton/Plano, TX area?

A: It could be a couple of things. Lots of cars have automatic oil light that comes on after so many miles. maybe when you had the oil changed, they forgot to reset it. Thats most likely what happened. (same thing just happened in my camaro). but it could be low on oil, I would check the oil yourself, or take it to another place to have it checked out. when it comes to garages, a second opinion is always best

I’ll be relocating to the New Carrollton, MD area in September. As I’m from Philly, PA, I know nothing of the area. Can anyone provide me with some information about: recommendations of best areas to live in (lowest crime rates, suburban-like areas, etc) and/or apartment complexes, average cost for car insurance/gas prices, if there are any city wage taxes in addition to state income tax, etc. I’m looking to stay within a 30 minute drive of New Carrollton. Any information would be great!

A: I use to live in Riverdale and Greenbelt which are less than 15 minutes from New Carrollton, MD. Like NC, they are suburban like area, the crime rates between each areas are comparable. However New Carrollton is busiest of the three. All are near a metro station, take a bus in Riverdale to NC metro station or one exit north of NC exit to Greenbelt Metro Station. There is also a metro station near Prince George Plaza in Hyattsville, MD

Rent in NCarrollton is high for garden apartments $800-$1000. However, there are small apartment units that are less, not fancy, but decent.

While I was a student at University of Maryland, I avoided apartments around campus and off University Blvd. Because people moved in and out so often, and parking was a problem.

I lived in Riverdale Towers Apt, off Riverdale Road. It is a garden high rise apartment that has six floors. The location was great for me 15 min from school, 10 min from work. I was able to take the bus to the subway station. Neighboring Riverdale Towers are Park Tanglewood, Oak Ridge, and Riverdale Village Apts. Parking is limited.

Crescent Square Apt on Crescent Road in Greenbelt, MD is one of the few inexpensive apartment complex. However they’re not fancy. It’s across the street from a gym, a post office, a credit union, a bank, a co-op, and auto mechanic, a gas station and in walking distance from a library. Police and the fire department are always in the area because the office is at the end of the the main road. I hated most the noise of the emergency vehicles and the buses during the weekday. Otherwise it was very peaceful. I lived in the section on Crescent Road, there are other buildings two blocks down that have balcony and patios. However managed by the same company.

I grew up in PG County. Areas that are closes to DC line seem to have higher rate of crime than those outside the beltway. If you can live in Philly, you can live in Prince George’s County MD.

There are federal and state taxes, no city wage taxes. The county gets you with tax on food, clothing, and other merchandise, as well as car and property.

Q: car registration, new in town?
hi,will be moving to carrollton tx from CA, my car registration expires december and moving to tx january.I was told that if i register in frisco or another area it will be cheaper. A: If you are moving to Carrollton, you wont be able to register in Frisco. The registration is done on the county level, so depending on where you are moving in Carrollton, you could be in Denton, Dallas, or Collin County. You should be able to find the costs at TxDot

Q: If you found a phone on the train would you turn it in or keep it? I need my numbers?
I dropped a Cingular silver Pantech C120 on the train on Thursday (Orange line to new carrollton). I was sitting on the last car. when I got of at stadium armory to transfer to the blue line and it was then when the doors were closing. that I realized that I didn’t have my phone. it fell out of my coat pocket on the seat.

( i did have a split second decision to get my phone, but to leave my stuff sitting on the platform. and my purse was in my bag. ) I chose to stay with my stuff and report it when I got to the end of the line. I cancelled the service on the phone and I just want the phone back to get my numbers.

I found a cell phone in a large store’s parking lot once. I scanned through the stored numbers, and sure enough, there was a number marked “home.” All it took was a phone call to that number. Needless to say, the owner of the phone was quite relieved. I told him I’d leave it at the service desk. The whole thing took less than five minutes.

I got hit in a car wreck. The other driver run a red light. The car he was driving had insurance coverage, and my car has insurance (liability coverage). My insurance company is not going to cover anything since it was not my fault and i pay for liability coverage only. WASHINGTON (AFP) – A 72-year-old man was arrested in the US state of Maryland after more than a million dollars’ worth of marijuana was found in his car by a police officer who was helping him with his bags, police said Thursday.

The arresting officer had seen the suspect back his car into another vehicle outside a roadside convenience store in New Carrollton, Maryland, the town’s police chief, David Rice, told AFP.

“The officer ran a check on the driver and found out his license was suspended,” Rice said.

He then asked the driver if he could help him to get items out of the car before it was impounded, Rice said.

The man, whom Rice identified as New York City resident Rondell Cole, asked the policeman “to pop the trunk, and when he did, the man grabbed this really big duffel bag and asked the officer if he could grab the other one.”

According to chief of police Rice, the officer was struck by the strong odors emanating from the bag.

A canine unit was called in “and when the dog hit on it, we opened the bag and thought, oh wow,” said Rice.

Inside the two bags were several bales of marijuana, each weighing around 25 pounds (11 kilograms), Rice said.

The haul, which has an estimated street value of around 1.3 million dollars, was one of the biggest in Maryland, Rice said.

Yes, what a loaded and incredibly subjective question. I’ll be staying in the LGD (technically, Central City as I’ll be on the north side of St. Charles. While I plan to visit the quarter and Marigny a lot, this time I want to check things out on the other side of the city (from Canal to Carrollton).

Q: What is the quickest way to get to Annapolis, MD from Washington, DC?
Specifically, I want to know what the quickest way is, by metro, train, bus, taxi, or any combination of the four, to get to St. John’s College in Annapolis, Maryland, from American University in Washington, D.C. According to Google Maps, the distance is 36 miles but it would take about 55 minutes to travel by car (most likely due to traffic I’m guessing). I’ve heard people taking the metro to the New Carrollton station and then taking either a commuter bus or taxi from there, but the buses only run during rush hours (which might defeat the purpose of trying to avoid traffic) and a taxi trip from there would cost about $50. Even though it’s expensive, Is that the quickest way possible? Or is there a quicker/less expensive way?

A: Least expensive option is a bus service such as Greyhound. It is also a pretty quick trip, but remember all vehicles on wheels will be subject to traffic jams. Annapolis is about an hour away, any way you travel. If you have a car, go ahead and drive. You won’t save barrels of time by using public transport, anyway.
